PBLRC RECOMMENDATION: The committee is unanimously recommending that we continue with the status quo regarding this practice. The status quo is defined as follows: The practice of trading away your first round draft pick and then signing a Comp FA is still considered to be against the “spirit of the rules” and is officially discouraged. While there is no official penalty for this practice provided by the PBLRC, we recommend that the commissioner retains the right to confer whatever penalty he deems appropriate for all GM’s who engage in this practice, deliberately or otherwise.
PBLRC ANALYSIS: This could have very easily been a split decision by the committee. We had two committee members who were in favor of keeping with the status quo, and we had two committee members who felt this is a loophole that should be closed more officially with a penalty that would both serve as a deterrent, and would also provide for the league a structured means to return to balance the result of such an offense. However, after much deliberation on several options, the committee was simply unable to come up with a penalty that was impactful, commensurate to the offense, and most importantly easy to implement. In the absence of being able to find a penalty that meets all of that criteria, the committee was thusly able to render a unanimous recommendation for making no changes at this time.

Commissioners Response: I agree with the committees response on topic #4 as I do think this does bring a certain loophole but there is no penalty that makes sense and therefore will remain an unwritten rule like so many other things in baseball. Kind of like not trying trying to bunt for a hit when the opposing pitcher is throwing a no hitter. If we can come up with a proper penalty then I am open to revisiting this topic next off-season.
